As It Files A Law Suit Against AG, CJ, COI Judges… APC In Court

 

Confirmed report states that the Office of the Master and Registrar of the Sierra Leone Judiciary has summoned the Attorney General and Minister of Justice, the Chief Justice and the three Judges sitting on the government appointed Commissions of Inquiry investigating the erstwhile All People’s Congress (APC) Government officials from November 2007 to April, 2018 to the Supreme Court.

The main opposition APC’s plea to the Supreme Court, the highest court of the realm, is for a stay to be put on the proceedings of the three Commissions of Inquiry on grounds that they were , they were illegally constituted.

It could be recalled that Defense Lawyers representing ‘Persons of Interest’ at the Commission, including Ady Macauley and Robin-Coker had argued before Justice Biobele Georgewill of Commission No. 1 that the Commissions lack validity, but the learned Judge ruled otherwise, citing that the President in Section 147 of the 1991 Constitution of Sierra Leone has the authority to set up Commissions of Inquiry.

The Nigerian Judge further asserted that the Commissions have the blessing of the House of Parliament since the constitutional instruments that culminated in their establishments were enacted by the august body.

Similar objection was also made at Commission No. 3 presided by Ghanaian Justice Atuguba, who had earlier ruled that his Commission had validity.

Meanwhile, the Supreme Court chaired by the Chief Justice, who has been accused by the main opposition APC of taking side in the establishment of the Commissions of Inquiry, would make the final judgment.
